====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 10-01-2025 Heard Mr. Kumar Kamal Nayan, the learned Counsel for the petitioner and Mr. Pradeep Narain Kumar, the learned Additional Public Prosecutor for the State.
2. The petitioner seeks bail, who is in custody since 01.05.2022 in connection with Sultanganj P.S. Case No. 41 of 2022, F.I.R. dated 16.02.2022 registered for the offence punishable under Sections 20,22 of N.D.P.S. Act.
3. Earlier the bail petition of the petitioner was rejected twice vide order dated 27.07.2023 and 21.06.2024 in Cr. Misc. No. 27.07.2023 and Cr. Misc. No. 44154 of 2024 respectively.
4. The case relates to recovery of 21 kgs. of ganja.
5. Vide order dated 28.11.2024, a report was called for with regard to the stage of the trial and report dated
Patna High Court CR. MISC. No.83225 of 2024(3) dt.10-01-2025 2/2 19.12.2024 of the learned trial Court reveals that out of five chargesheeted witnesses, four witnesses have already been examined and the case is pending for the examination of the one prosecution witness i.e. Investigating Officer.
6. Considering the nature of allegation in the F.I.R. as well as the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Sultanganj P.S. Case No. 41 of 2022 pending in the court of learned Sessions Judge, Bhagalpur.
7. However, the learned trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Neha/- U T
