JUSTICE SHIVAJI PANDEY ORAL ORDER 06-10-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek anticipatory bail in a case instituted for the offences under Sections 147, 149, 341, 323, 332, 333, 353, 307 and 504 of the Indian Penal Code.

Allegation has been made that on account of accident of a truck the people of the locality has paralyzed the movement of the vehicles. When the police party went there to clear the blockage they have misbehaved with the police party. No specific overt act has been alleged against the petitioners.

Looking to the facts and circumstances of the case, in the

Patna High Court Cr.Misc. No.58924 of 2018 (2) dt.06-10-2018 2 /2 event of arrest or surrender within four weeks from today, let petitioners, namely, Gaurav Kumar and Saurabh Kumar, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Sarmera P.S. Case No.76 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that if the petitioners will be found indulged in such type of activity in future prosecution will be at liberty to make a prayer for cancellation of bail.
