Patna High Court CWJC No.21905 of 2019(2) dt.19-11-2019 2/2 removal of encroachment made over public land/ road. The learned counsel for the petitioner has limited his prayer only for removal of encroachment made by the private respondents over the public land/ road in question. This Court is of the opinion that in case the petitioner seeks removal of encroachment from the public land/ road, he is required to approach the Circle Officer, Turkaulia, East Champaran under the provisions of the Bihar Public Land Encroachment Act, 1956.

Accordingly, liberty is granted to the petitioner to approach the Circle Officer, Turkaulia, East Champaran and in case appropriate complaint is filed under the provisions of the Bihar Public Land Encroachment Act, 1956, the said Circle Officer shall examine the same and proceed in accordance with the provisions contained under the Act, 1956. The writ petition stands disposed of on the aforesaid terms.
