Mr. Nand Kishore Pd ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 20-09-2018 Heard Sri Babu Nandan Prasad, learned counsel for the petitioner and Sri Nand Kishore Prasad, learned Addl. Public Prosecutor.
The sole petitioner, husband of the informant, apprehending his arrest in Mahila(Rohtas) P.S. Case No. 30 of 2018 registered for offence under Sections 498(A), 341, 323/34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, 1961, has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner, by way of referring to F.I.R., submits that contents of the F.I.R. indicate that false accusation has been made. On aforesaid ground, a prayer has been made for granting anticipatory bail.
However, I am of the opinion that since the petitioner
Patna High Court Cr.Misc. No.58688 of 2018(2) dt.20-09-2018 2/2 is husband and there is specific accusation, there is no reason to grant anticipatory bail.
The prayer for anticipatory bail stands dismissed. (Rakesh Kumar, J,) anay U T
