The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 186, 224, 225, 353, 332/34 of the Indian Penal Code. According to prosecution case the informant is PSI of Laukaha P.S. on the date and time of occurrence when the informant along with other police personnel went to arrest Rajendra Yadav who is accused of Laukaha P.S. Case No. 255 of 2018, the petitioners collected there and started to assault to the informant and they became success to release the accused

Patna High Court CR. MISC. No.76397 of 2019(2) dt.27-11-2019 2/2 from the police custody and they also tried to snatched government riffle from the police.

Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Prosecution story is false and concocted. He submits that petitioner nos. 2, 4, and 6 have no criminal antecedent and petitioner nos. 1, 3 and 5 have one criminal antecedent i.e. Laukaha P.S. Case No. 255 of 2018 under Section 341, 323, 353, 384, 504, 506 of the Indian Penal Code.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, their payer for anticipatory bail is rejected in connection with Laukaha P.S. Case No. 152 of 2019, corresponding to G.R. No. 957 of 2019 pending before the court of the learned 1st Class Judicial Magistrate, Jhanjharpur, Madhubani.

Accordingly, the application is dismissed.
