2. The petitioners seek bail in a case registered for offence under Sections 103(2) of the B.N.S., 2023

The informant alleges that her co-villagers Rahul, Ravi Ranjan, Vipin, Gorelal, Pankaj and Prabhat came to her house and called her son Mrityunjay and co-villager Pravesh and took them to Hardiya Asthan and told them that they committed theft in their house hence will kill them. The informant further alleges that she along with her daughter went to Hardiya Asthan where they saw the accused persons including these petitioners along with 10 unknown accused assaulting her son and Pravesh by lathi and danda, accordingly the informant intervened when she along with her daughter were also assaulted and accused fled. Thereafter, police was informed
Patna High Court CR. MISC. No.76182 of 2025(2) dt.14-11-2025 2/3 and the injured were taken to hospital where Mrityunjay (informant's son) died during course of treatment.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in this case. Prior to lodging of the present case, one Ravi Ranjan Kumar instituted a case, vide Nawada Mufassil P.S. Case No. 83 of 2025 dated 27.02.2025 for theft in the house and the deceased (informant's son) and his friend were apprehended & interrogated and thereafter, stolen articles were recovered. The deceased and his friend Pravesh Kumar admitted that they had committed theft in several houses and also in the house of Ravi Ranjan Kumar. Allegation of assault is general and omnibus. The associate of the deceased namely Pravesh Kumar admitted that he was caught by the villagers while committing theft and the deceased (informant's son) fled away, but was subsequently caught.
Large number of stolen articles were recovered from the possession of son of informant and his associate and as they were found to be in injured condition, were taken to hospital. Learned counsel further submits that informant lodged this case subsequently after coming to know about the death of her son.
Patna High Court CR. MISC. No.76182 of 2025(2) dt.14-11-2025 3/3 Court, vide order dated 08.10.2025 passed in Cr.Misc. No. 35716 of 2025 with Cr.Misc. No. 36577 of 2025 (Annexure - 2). Petitioners have got clean antecedent and are in custody since 18.06.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Nawada / concerned Court in connection with Mufassil P.S. Case No. 84 of 2025.
