Learned Counsel for the petitioner submits that show-cause has been filed and from the show-cause it is submitted that Section 107 Cr.P.C. proceeding has been drawn and till pendency of the 107 Cr.P.C. proceeding, it has been reported that both parties are living peacefully and, therefore, it has been dropped. Counsel submits that this is not the real reflection of the said Rule, namely, Bihar Maintenance & Welfare of Parents and Senior Citizens Rules, 2012.

3. Learned Counsel for the State submits that after receiving the representation, peaceful possession from both the parties have been maintained and, therefore, the proceeding has been dropped.

4. In this view of the matter, this Court finds that there is no need of continuation of the M.J.C. petition. This M.J.C. petition is hereby dropped. However, if the petitioner being a Senior Citizen shall be disturbed, he shall always liberty to move under the said rule, namely, Bihar Maintenance & Welfare of Parents and Senior Citizens Rules, 2012, before the Superintendent of Police, Katihar, as per the statue.

5. Accordingly, the M.J.C. application stands dismissed.
