1. Heard learned counsel for the petitioner and learned APP for the State
2. The petitioner has preferred this application for grant of regular bail in connection with Mahishi P.S. Case no. 149 of 2023 registered under sections 307, 341, 342, 323, 324, 379 and 34 of the Indian Penal Code.
3. As per the prosecution case, the informant states that her son who was taken away by the petitioner and one Sanjeet Ram did not return home. On the next day he was found in an injured condition and was taken to the hospital for treatment.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No such occurrence as alleged in the F.I.R has taken place. Co-accused
Patna High Court CR. MISC. No.83267 of 2023(2) dt.10-01-2024 2/2 Sanjeet Ram has been enlarged on bail vide order dated 15.12.2023 passed in Cr. Misc. Case no. 81217 of 2023. The petitioner is in custody since 20.6.2023 and has no criminal antecedent.
5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, the grant of bail to co-accused Sanjeet Ram, the petitioner being in custody for more than 6 months since 20.6.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Mahishi P.S. Case no. 149 of 2023 , on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa.
