2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition of Excise Act, 2018.

3. As per the prosecution case, 20.20 litres of foreign liquor has been recovered from the house of the petitioner.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that recovery of alleged illicit liquor was not made from physical possession of the petitioner rather from a out house which was an open area easily accessible to one and all. Petitioner claims to be clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court no.2, Patna, in connection with Jakkanpur P.S. Case No. 552 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
