2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 351(2), 3(5) of the B.N.S.

3. The allegation in the first information report is that the petitioner along with other co-accused persons have assaulted the son of the informant causing injury.

4. Learned counsel for the petitioner submits that there are general and omnibus allegations of assault against the petitioner and the injuries sustained by the informant along with others victims are simple in nature caused by hard and blunt substance as indicated clearly in the bail rejection order of the learned Sessions Judge. Further, the said order itself indicates that all other similarly situated co-accused persons have already

Patna High Court CR. MISC. No.77617 of 2025(2) dt.27-11-2025 2/2 been granted anticipatory bail by the learned Sessions Judge and only on account of non-disclosure of one criminal antecedent he was denied such privilege.

5. Learned APP for the State opposed the grant of anticipatory bail on the basis of allegations made in the first information report.

6. Taking into consideration the facts and circumstances and considering that there are general and omnibus allegation of assault coupled with the fact that it has produced simple injuries, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Ghoshi (Okri) P.S. Case No. 419 of 2025, subject to the condition as laid down under Section 438

(2) of the Cr.P.C/ Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
