2. In this case, the petitioner is seeking regular bail in connection with Amnour P.S. Case No. 300 of 2025, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act and Section 25(1-B)(a), 26, 35 of Arms Act and Sections 217 and 248 of BNS.

3. As per allegation, the petitioner falsely implicated Omprakash Singh @ Bittu Singh and on his false fard beyan, Amnour P.S. Case No. 212 of 2025 was lodged against Omprakash Singh @ Bittu Singh. The petitioner handed

No.76272 of 2025(3) dt.05-02-2026 2/3 over country made pistol and 500 ml English liquor in the hands of Omprakash Singh @ Bittu Singh and dragged him to police station and Omprakash Singh @ Bittu Singh was arrested. During investigation of Amnour P.S. Case No. 212 of 2025, the case was not found true against Omprakash Singh @ Bittu Singh under the arms act and Section 30(a) of Excise Act, but the case was found true against section 37(b) of Bihar Prohibition and Excise Act and other allied Sections of BNS.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. So far as the allegation against Omprakash Singh @ Bittu Singh in Amnour P.S. Case No. 212 of 2025 is concerned, the entire allegation was not found false. The charge-sheet was submitted under Section 37(b) of Bihar Prohibition and Excise Act.

On the other hand, the learned counsel for Omprakash Singh @ Bittu Singh (the alleged victim) has submitted that the petitioner forcibly brought the victim to the police station, providing him with a country-made pistol and liquor and he maliciously prosecuted him. He has also submitted that Omprakash Singh @ Bittu Singh has also lodged a case against the petitioner.

6. Be that as it may, the petitioner has remained under custody for near about four months.

7. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise-1, Saran at Chapra/concerned court below in connection with Amnour P.S. Case No. 300 of 2025,, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
