The petitioner seeks pre-arrest bail in connection with Kasim Bazar P.S. Case No. 111 of 2019 (G.R. No. 1433 of 2019), registered under Section 392 of the Indian Penal Code. The accusation is that in the night of 31.05.2019 at about 02.00-03.00 a.m. some unidentified persons, variously armed, entered into the house of the informant and committed loot of several gold and silver articles, cash of Rs.30,000/- and ATM Card.
Submission is that petitioner is not named in the first information report. In course of investigation the name of petitioner has surfaced in the confessional statement of coaccused, Neeraj Yadav and Bhola Yadav. In fact, the petitioner

No.71289 of 2019(2) dt.11-12-2019 2/2 was accused in two cases before the present case, due to that reason the petitioner has been falsely implicated in this case showing his name in the confessional statement of co-accused. Further, submission is that petitioner is in custody since 26.06.2019.
Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kasim Bazar P.S. Case No. 111 of 2019 (G.R. No. 1433 of 2019) to the satisfaction of the Chief Judicial Magistrate, Munger, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
