Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners seek bail in connection with Excise Case No. 299 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Learned counsel for the petitioners submits that there is recovery of 569.700 liters of illegal foreign liquor from the Duster Car and petitioners belong to driver of the said car. Petitioners are in jail custody since 03.09.2019. He further
Patna High Court CR. MISC. No.70632 of 2019(2) dt.25-11-2019 2/2 submits that the petitioners have got no any criminal antecedent. In the facts and circumstances of the case, I am inclined to grant bail to the petitioners, subject to deposit of Rs.25,000/- in the court below/Nazarat. Let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge cum Special Judge (Excise), Gopalganj in connection with Excise Case No. 299 of 2019.
Such deposit of Rs.25,000/- shall abide by the outcome of the criminal case.
