2. Petitioner is apprehending his arrest in a case registered for the offences punishable under sections 420 and 406 of the Indian Penal Code .
3. The allegation in the complaint is that the complainant had given a cheque of Rs. 50,000/- in the name of the petitioner along with cash amount of Rs. 10,000/- for securing a job for his son in NTPC but the same was not done.
4. Learned counsel for the petitioner submits at the outset that petitioner has nothing to do with the NTPC and hence, the entire story of securing a job for the complainant's son at NTPC, Navinagar has no basis. Further, the petitioner has actually given a friendly loan of Rs. 50,000/- to the
Patna High Court CR. MISC. No.80281 of 2024(6) dt.03-07-2025 2/2 complainant and the same was returned to him by the complainant but the same has been given different colour in the present complaint petition. The matter had also been sent to the Mediation Centre but mediation process failed.
5. The learned counsel for the informant has supported the allegation made in the complaint.

Taking into consideration the rival contentions of the parties, that the very payment of the alleged money is for an unlawful purpose, I am inclined to grant privilege of anticipatory bail to the petitioner, let in the event of his arrest/ surrender within a period of four weeks from today, the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in connection with Complaint Case No. 198 of 2019, subject to condition as laid down under section 438(2) of the Cr.PC and subject to the further condition that the petitioner shall co-operate in investigation/ trial.
