ANJANA MISHRA ORAL ORDER 19-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 30.05.2019, in connection with Rasulpur P.S. Case No. 42 of 2019 for the offenses under Sections 447, 341, 323, 504, 307, 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that only on account of previous enmity and local politics, the present case has been filed by the informant. It is further submitted that the allegation against the petitioner is of having assaulted with farsa so that a case under Section 307 be made out but there is no repetition of blows. It is submitted that though the injury appears to be treated at Gorakhpur and Lucknow, the initial injury report by the local Doctor is not on record. Learned

No.71550 of 2019(2) dt.19-11-2019 2/2 counsel for the petitioner further submits that the petitioner has got a clean antecedent and he has been in jail custody for almost more than five months. There is also a delay in lodging F.I.R. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XI, Saran (Chapra) in connection with Rasulpur P.S.
