The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Town P.S. Case No. 233 of 2018 dated 08.04.2018 instituted for the offences under Sections 399 and 402 of the Indian Penal Code and under Section 25(1-B)A, 26 (2) and 35 of the Arms Act.

Though the name of the petitioner has been taken by two of the arrested accused persons and nothing has been recovered from his possession, I am not inclined to grant anticipatory bail to him for the reason that earlier to this case, he has been made accused in another case Vide Hajipur Town P.S. Case No. 77 of 2018 instituted under Sections 467, 468, 471,

Patna High Court Cr.Misc. No.64057 of 2018(2) dt.17-12-2018 2/2 420, 120(B)/34 of the Indian Penal Code, Sections 3, 4, 11 of the Public Gambling Act, 1967 and Sections 3 and 4 of the Bihar Lottery Act.

The prayer for anticipatory bail is rejected. However if the petitioner surrenders before the court below within four weeks and seeks regular bail, the court below shall not be prejudiced by the fact that the present petition has not been entertained.
