2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 447, 308, 504, 506, 34 of the Indian Penal Code.

3. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Petitioner has got no criminal antecedent mentioned in Para 3 of the bail application. Earlier, the petitioner was granted the benefit of Section 41(1) Cr.P.C. Later on charge-sheet has been submitted by the police. Therefore, the petitioner has moved anticipatory bail application before this Court. He further submits that there is no specific overt act against this petitioner

Patna High Court CR. MISC. No.81221 of 2023(2) dt.20-12-2023 2/2 rather there is general and omnibus allegation against the petitioner. He fairly submits that court below has issued process of 82 Cr.P.C against the petitioner but 83 Cr.P.C. has not been issued by the court below. He further submits that anticipatory bail application of the petitioner is not pending when process of 82 is issued against the petitioner.

4. Learned APP for the State has opposes the prayer for bail.

Having regard to the facts and circumstances of the case and also process of 83 Cr.P.C. is not issued against the petitioner, let the above named petitioner, be released on bail, in the event of his arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Cheriya Bariyarpur P.S. Case No. 160/2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) Ranjeet/- U T
