The petitioner apprehends his arrest in connection with Hasanpur P.S. Case no. 68 of 2018 registered under Sections 307, 323, 325, 341, 354(A) and 379/34 of the Indian Penal Code.
Petitioner along with other accused persons are said to have intruded into the courtyard of the informant and started raising wall therein. On protest made by the informant, petitioner gave two blows by means of rod on her head. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Patna High Court Cr.Misc. No.63221 of 2018(2) dt.18-12-2018 2/2 implicated in the case as he had intervened the brawl between the ladies of the two families over land dispute. He is said to have assaulted the informant twice by means of rod on her head, but the doctor has found only one lacerated wound on the head of the informant which is simple in nature caused by hard and blunt substance.
In the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Rosera, Samastipur in connection with Hasanpur P.S. Case No. 68 of 2018, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
