====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 04-12-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Madhepura Cyber P.S. Case No.24 of 2024 instituted under Sections 354, 354(A) (B) (C) (D), 504, 506/34 of the Indian Penal Code and under Sections 66, 67(B) of I.T. Act, 2000.

3. As per the prosecution case, co-accused Sonu Kumar prepared facebook I.D., Instagram I.D. of the informant and send illegal message and also made viral of the photo of informant. The allegation against the petitioners is that when the informant made complaint to the petitioners who are uncle and grandfather of co-accused Sonu Kumar, they have abused and assaulted her with lathi and danda.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.80278 of 2024(2) dt.04-12-2024 2/2 petitioners are innocent and have been falsely implicated in this case. He further submits that there is general allegation against the petitioners. Learned counsel submits that co-accused Sonu Kumar is living separately from the petitioners and they have no concern with the affairs of the co-accused Sonu Kumar. He further submits that petitioners have no criminal antecedent and they undertake to cooperate in the investigation.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura Cyber P.S. Case No.24 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
