1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 109, 329(3), 74 and 352 of the BNS.
3. Learned counsel for the petitioner submits that petitioner has antecedent of five cases and the informant alleges that the accused persons including the petitioner along with four unknown accused came and petitioner caught her husband and dragged him outside the house. Further, on orders of Hareram, accused Chhotelal and Rohit stabbed the husband of the informant repeatedly on his back causing injury while Shravan and Sonu had caught his leg and hands and petitioner and
Patna High Court CR. MISC. No.76571 of 2025(2) dt.01-12-2025 2/3 Guddu assaulted her when she intervened to save her husband.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of assaulting the husband of the informant by knife is against Chhotelal and Rohit. It is also submitted that the date of occurrence is 19.02.2025 and the FIR came to be instituted on 22.02.2025.

Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioner and submits that no doubt, petitioner is not alleged to have stabbed the husband of the informant but then his presence at the place of occurrence emboldened Chhotelal and Rohit to commit the occurrence of stabbing. It is further submitted that petitioner has antecedent of five cases and if privilege of anticipatory bail is granted to the petitioner, the petitioner may abscond.
6. Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner in connection with Kundwa Chainpur P.S. Case No. 56 of 2025 pending in the Court of learned Judicial Magistrate, 1st Class, Sikarahana at
Patna High Court CR. MISC. No.76571 of 2025(2) dt.01-12-2025 3/3 Dhaka, East Champaran at Motihari/Successor Court.
