Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Khodawandpur P.S. Case No. 124/2018 registered for the offence punishable under Sections 147/148/149/447/341/323/ 379 /386/504/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.64670 of 2018(3) dt.23-05-2019 2/2 occurrence took place because the informant's side was constructing the house on the land in question which belongs to the present petitioners and there has been a land dispute with regard to the said land between the parties. Earlier also, a proceeding under Section 144 Cr.P.C. and 107 of the I.P.C. was started at the instance of the petitioner No. 4 and, therefore, the petitioners have now been falsely implicated in the present case with allegations of snatching of money etc. so as to put the present petitioners behind the bar.
Considering the aforementioned facts and circumstances and the nature of the dispute which has led to the occurrence, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Begusarai, in connection with Khodawandpur P.S. Case No. 124/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
