The petitioner seeks regular bail in connection with Tarari PS case no. 46 of 2006 instituted for the offence punishable under Sections 25(1-b)a, 26, 35 of Arms Act, 3/4 of Explosive Substance Act and 17 C.L.Act.

The allegation is regarding the police having received secret information that certain notorious extremists had gathered and were planning to commit some crime, whereafter raid was conducted at the house of the co-accused person namely Ashok Nut @ Dara and arms were recovered and he disclosed that the persons who had fled away, was the petitioner and others.

The learned counsel for the petitioner has

No.73029 of 2019(2) dt.14-01-2020 2/2 submitted that the said co-accused person namely Ashok Nut @ Dara has already been granted bail by this Hon'ble Court and as far as the petitioner is concerned, no recovery of illicit arms has been made from his possession. It is further submitted that the petitioner is languishing in custody since 17.07.2019. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IXth, Bhojpur at Ara in connection with Tarari PS case no. 46 of 2006.
