This is an application for grant of anticipatory bail in connection with Mahila P.S. Case No. 18 of 2015 registered for the offence punishable under Sections 341, 323, 354(D), 506 of the Indian Penal Code and Section 8 of the Prevention of Children from Sexual Offence Act.

The allegation is regarding the petitioner having alleged to have intentionally pushed the daughter of the informant and used vulgar language. It is further alleged that the petitioner used to send dirty messages to the daughter of the informant on the mobile.

The learned counsel for the petitioner has submitted that the petitioner is innocent and he has been falsely implicated in

Patna High Court CR. MISC. No.83859 of 2019(3) dt.06-01-2020 2/2 the present case. It is further submitted that the petitioner is having a clean antecedent and admittedly, there is no proof of the petitioner having sent any dirty message on the mobile of the daughter of the informant.

Considering the facts and circumstances of the case as also taking into account the fact that the petitioner is having a clean antecedent and no material is on record to show that the petitioner had sent dirty messages on the mobile of the daughter of the informant, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st, Bhagalpur in connection with Mahila P.S. Case No. 18 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
