2. The petitioner seeks bail in connection with Nauhatta P.S. Case No. 70/2023 registered for the offence punishable under Sections 302/201/34 of the Indian Penal Code.

3. From the reading of the statement of the witness Sursato Devi, it appears that five persons started assaulting the deceased as he was found sleeping with Sursato Devi. Thereafter, Ajay Singh reached there. The deceased was taken by five persons and Ajay Singh has also accompanied them. Subsequently, deadbody of the deceased was found. The petitioner is Dewar of the Sursato Devi. The allegations against the petitioner is of killing the deceased.

4. The petitioner is in custody since 14.05.2023 and he has clean antecedent.

5. The petitioner is not said to have participated in the initial assault on the deceased.

6. Considering the above, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dehri, Rohtas in connection with Nauhatta P.S. Case No. 70/2023.
