The petitioner apprehends his arrest in connection with Sultanganj P.S. Case no. 51 of 2019, registered under Sections 147, 148, 149, 323, 324, 307 and 427 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is that informant was called by the petitioner, thereafter, other co-accused named in the F.I.R. caused assault to the informant though hockey stick, lathi and iron rod due to non-payment of ransom by the informant, who was engaged in the construction work of Nal-Jal Yojana. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Moreover, no allegation has been made against the petitioner to cause assault
Patna High Court CR. MISC. No.70251 of 2019(2) dt.31-01-2020 2/2 to the informant. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-I, Bhagalpur in connection with Sultanganj P.S. Case No. 51 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
