JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Section 7 of the E.C. Act. In huge quantity rice and paddy kept in 299 bags were recovered from the truck. The petitioner happens to be owner of the aforesaid truck.
The informant claims that the petitioner and other F.I.R named accused were involved in smuggling of the seized rice and paddy. It is an admitted position that there is no control order of transportation of rice and paddy. Moreover, there appears to be nothing on the record to show that the seized rice and paddy were lifted from the government godown. Moreover,
Patna High Court Cr.Misc. No.69487 of 2018(2) dt.17-12-2018 2/2 the owner of the seized rice and paddy has already been granted privilege of anticipatory bail by a co-ordinate Bench of this court vide order dated 25.05.2017 passed in Cr. Misc. No. 23238 of 2017.
Accordingly, it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Madhepura in Madhepura P.S. Case No. 621 of 2016 subject to condition as laid down under Section 438(2) of the Cr.P.C.
