2. The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 120(B) and 34 of the Indian Penal Code.
3. The prosecution case, in brief, is that accused Ranjeet Yadav (labour contractor) engaged the son of informant,nemly, SakaladeoChaupal inRipu Raj Rice Mill and on 12.12.2022 the informant received nformation that her son has been murdered. At about 2:30 P.M. co-accused Sarwan Yadav along with his associates brought the dead body of son of informant at the door of informant and after keeping the dead body, accused Sarwan yadav tried to flee away but villagers apprehended him. On query, the informant came to know that accused Ranjeet Yadav, Sarwan Yadav and Sanjeev Yadav under criminal conspiracy have committed murdered of his son by filling air with pipe in his anus.

4. It is submitted on behalf of the petitioner that he has falsely been implicated in the present case and he is not named in F.I.R. and his name has transpired during the course of investigation. Only material that has come against the petitioner is that he along with other accused persons were seen taking the deceased to hospital for treatment. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul, Motihari, in connection with Ramgarhwa P.S. Case No.429 of 2022, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
