JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-12-2019 This application, for grant of anticipatory bail, arises out of Marhowrah (Gaura) P.S. Case No. 586 of 2019, disclosing offences under Sections 341, 353, 323, 308, 120(B), 427/34, 504 and 506 of the Indian Penal Code. Petitioners are named in the F.I.R. and there is allegation that while the police has went to the village on the informant that one Bhrigu Manjhi is selling the wine, the petitioners and several others abused the police party and also started brick batting and they further damaged the police vehicle.

Submission of learned counsel for the petitioners is that they have no criminal antecedent and have falsely been

No.70176 of 2019(3) dt.09-12-2019 2/2 implicated in this case and the F.I.R. and the materials collected during course of investigation does not show any recovery of liquor and save and except that petitioners are named in the F.I.R, there is absolutely nothing against them. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Marhowrah (Gaura) P.S. Case No. 586 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
