The petitioner seeks regular bail in connection with Excise Case No. 425 of 2019, registration no. 475 of 2019 for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment ) Act, 2018. The allegation is regarding recovery of 35.280 liters of illicit liquor from a hut situated in the front of the house of the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 23.09.2019.

Patna High Court CR. MISC. No.69766 of 2019(2) dt.10-01-2020 2/2 Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-IIcum- Special Judge Excise, Samastipur in connection with Excise Case No. 425 of 2019, registration no. 475 of 2019.
