The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.
The prosecution case, in brief, is that in the backdrop of withdrawal of a case lodged, a dispute arose and ultimately, the accused persons are alleged to have assaulted the prosecution party.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. There is case and counter case between the parties. A free fight is alleged to
Patna High Court Cr.Misc. No.66859 of 2018 (2) dt.01-11-2018 have taken place. One injury is simple in nature and the other injury said to be grievous, is on the non-vital part of the body. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 10 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
