The petitioner, who is in custody since 13.09.2019, seeks bail in connection with Sono P.S. Case No. 89 of 2019 which has been instituted for the offence under Section 302/34 of the Indian Penal Code.

The allegation in the FIR is of assaulting the deceased by all the accused persons including the petitioner. It has been submitted on behalf of the petitioner that only two injuries were found on the person of the deceased. Some of the other accused persons, who are alleged to have assaulted the deceased, have been granted

Patna High Court CR. MISC. No.70022 of 2019(2) dt.04-12-2019 2/2 bail by different Benches of this Court and some of the orders have been enclosed with the petition. It has further been submitted that the deceased earlier was made accused for having molested a girl of a Coaching Centre. Because of the fact that he had made an attempt to jump from the roof-top to save himself from the attack of the irate crowd and injured himself, this opportunity was taken as a method of falsely implicating the persons who had opposed his activities in the past.

Considering the background facts, the period of custody; the clean antecedent of the petitioner and that the similarly situated persons have been granted bail, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Jamui in connection with Sono P.S.
