The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

The prosecution case, in brief, is that the accused persons started abusing the widow mother of the informant and on protest, the accused persons assaulted the informant. Except injury No. 3, the doctor has found the injuries to be simple in nature. General and omnibus allegation has been made against the accused persons. The petitioner cannot be alleged to be author of the injury No. 3.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.67174 of 2018(2) dt.22-11-2018 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. Except the injury No. 3, the doctor has found all the injuries to be simple in nature. General and omnibus allegation has been made against the accused persons. The petitioner cannot alleged to be author of injury No. 3.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Mukesh Kumar Mishra, learned Judicial Magistrate-Ist Class, Jehanabad in connection with Makhdumpur P.S. Case No. 84 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
