The petitioner has filed the instant application for grant of regular bail in connection with Alipur P.S. Case No. 02 of 2023 registered under sections147, 149, 341, 323, 325, 354, 307, 504, 506 of the Indian Penal Code.

Allegation against the petitioner and co-accused persons is that they armed with various weapons came at his house and assaulted the informant and his family members due to which they sustained injuries.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The occurrence took place on 17.12.2022 and the FIR was registered on 03.01.2023

Patna High Court CR. MISC. No.79770 of 2023(2) dt.11-12-2023 2/2 without given any cogent reason. There is no specific allegation levelled against the petitioner. Similarly situated co-accused has already been granted bail by this Court vide order dated 11.09.2023 passed in Cr. Misc. No. 60222 of 2023. It is further submitted that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 13.08.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Alipur P.S. Case No. 02 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya.
