2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 103(1) and 61(2) of the B.N.S. and Section 27 of the Arms Act and later on, Sections 25(1-B)a, 26 and 35 of the Arms Act were added.

3. As per prosecution case, on 11.07.2025, son of informant, who had recently returned from Delhi, was shot dead by some unknown persons and the dead body was found in a forest. The mobile phone of the deceased was also found missing.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R.. During course of investigation, one Saheb Singh was

No.77261 of 2025(5) dt.15-01-2026 2/3 apprehended who, in this confessional statement, admitted that he killed the son of informant in retaliation to an incident of misbehavior with his daughter at a marriage ceremony. He further disclosed that he, in a planned conspiracy with his son, namely Kundan Kumar and one Sajan Kumar, instructed one Raushan Kumar, who shot the deceased. Name of petitioner does not figure at all in the said confessional statement. Coaccused Sanjay Kumar named this petitioner. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, materials that have surfaced during course of investigation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
