JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 414 and 413 of the Indian Penal Code and sections 25(1-b) a/(1-A)/(1-AA)/ 26,35 of the Arms Act.

Admittedly, the recovery of illegal firearms were made from the house of Rajendra Prasad Yadav and the name of this petitioner was disclosed by one Jackey Kumar, who was apprehended by the police at the time of raid and recovery. Petitioner does not have any criminal antecedent which is evident from perusal of Para-3 of the petition. Considering the aforesaid facts and circumstances as

No.67536 of 2018(2) dt.06-12-2018 2/2 well as submissions of the parties, particularly keeping in mind that neither petitioner was caught on the spot nor anything was recovered from his conscious possession, let above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Rampur P.S. Case No. 329 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
