JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks regular bail in connection with Sessions Trial No. 23 of 1994 arising out of Nawada P.S. Case No. 03 of 1993 registered for the offence punishable under Sections 307, 323, 325 and 345 of the Indian Penal Code. As per FIR, allegation against the petitioner is that he assaulted on the head of the informant by means of hammer causing grievous injury. Earlier the prayer for bail of the petitioner was rejected by trial court thereafter the petitioner has managed to escape from the police custody.
Submission of the learned counsel for the petitioner is that he is not mentally sound and as such he has no knowledge of where he was after he escaped from police custody. The petitioner is in custody since 21.08.2019.

Patna High Court CR. MISC. No.83934 of 2019(4) dt.24-02-2020 2/2 counsel for the informant, who vehemently opposed the prayer for bail of the petitioner. He further submits that the injury was found to be grievous in nature.
Considering the nature of allegation and in view of the aforesaid facts and circumstances, I am not inclined to grant regular bail at this stage. However, if the trial is not concluded within a period of six months, the petitioner shall be at liberty to renew his prayer for bail.
