1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Khagaria P.S. Case No. 309 of 2024 dated 04.06.2024 registered for the offence under Section 356, 379 of the I.P.C later on Section 392 I.P.C. added.

3. As per the first information report the informant runs a CSP Centre of the Bank of Baroda and on the fateful day of 03.06.2024 at about 04:00 P.M. while he was going to deposit Rs. 3,50,000/-, he was robbed by three persons after dashing his motorcycle as a result of which his aunt Rubi Devi fell down.

4. Mr. S.K. Lal, learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner has transpired on the basis of confessional statement

Patna High Court CR. MISC. No.84566 of 2024(2) dt.07-01-2025 2/2 of the co-accused / Santosh Kumar. During investigation, no material has come to connect the petitioner with the present offence. The petitioner has not been put on T.I.P.

5. Regard being had to the submission made by the parties, taking into consideration the nature of allegation and the fact that the petitioner is having six criminal antecedent of identical nature and material collected during course of investigation may be the basis of further investigation may be after custodial interrogation, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected.
