2. In the present writ application, the petitioner has prayed for the grant of following reliefs:

(i) For issuance of an appropriate writ/ writs, order/ orders or direction/ directions in the nature of writ of Mandamus, commanding and directing the respondents concerned and its authority to pay entire dues salary within suitable time to

Patna High Court CWJC No.18528 of 2025(2) dt.18-11-2025 2/3 the petitioners, which has been withheld since September 2017 (ii) Further directing to the respondents to put attendance on attendance register.

(iii) Further, for issuance of any other appropriate writ/writs, order/orders or direction/directions for which petitioner would be found entitled under the facts and circumstances of the case.

3. Learned counsel for the respondent-State submits that the writ application is not maintainable in view of the fact that there is an alternative statutory remedy available before the District Appellate Authority.

4. Learned counsel for the petitioner submits that he is prepared to approach the District Appellate Authority and prays that liberty be given to the petitioner to avail the said statutory alternative remedy.

Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of granting liberty to the petitioner to file an appropriate application before the District Appellate Authority for claiming the relief as claimed for in the present writ application. The delay in filing the application before the

Patna High Court CWJC No.18528 of 2025(2) dt.18-11-2025 3/3 District Appellate Authority shall be considered by the said Authority in accordance with law and the period during which the writ application was pending will be taken into account. The petitioner is granted liberty to file such application before the District Appellate Authority within one month from today and if such an application is filed within the stipulated time, the same shall be heard and decided within a maximum period of six months from the date of receipt of the application. All concerned parties including the petitioner should be heard by the District Appellate Authority and the final order which shall be passed must be a reasoned and speaking order.

6. With the aforesaid observation/direction and liberty granted, this writ application is disposed of. All pending interlocutory application(s), if any, shall also be deemed to have been disposed of.
