JUSTICE SUDHIR SINGH ORAL ORDER 21-12-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner is apprehending her arrest in a case registered under Sections 147, 148, 149, 302, 379, 323, 337, 427, 504 of the Indian Penal Code and 27 of the Arms Act. Allegation is that the accused persons abused the informant and thereafter accused Vikash Kumar fired on Arvind Ram and ultimately Arvind Ram fell down and the injured was sent to the Hospital for treatment, but he died. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is said to have assaulted the

Patna High Court Cr.Misc. No.68874 of 2018(2) dt.21-12-2018 2/2 daughter of the deceased. The nature of injury is said to be simple. The main allegation is agaisnt co-accused Vikash Kumar, who is said to have fired upon the deceased. The petitioner is a lady.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st at Hilsa, Nalanda in connection with Chandi P.S. case No.130 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
