The petitioner is apprehending his arrest in connection with Barun P.S. Case No. 17 of 2019 for the offence registered under Sections 147, 149, 341, 323, 308, 353, 379, 411 and 420 of the Indian Penal Code and Section 4/40 of the B.M.R.C. and also Section 15 of the Environment Protection Act. Learned counsel for the petitioner submits that he is the owner of Tractor which was allegedly seized. It is further submitted that he has no concern and the driver of the vehicle was solely responsible for carrying the sand which was not having any valid receipt. It is further submitted that having no knowledge of the same, the petitioner cannot be held to be responsible for the alleged act of loading sand on his Tractor.

No.73114 of 2019(2) dt.25-11-2019 2/2 Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S.
