2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 126(2), 115(2), 109(1), 352, 351(2), 3(5) of the BNS. 3 . As per the prosecution case , on the alleged date and time of occurrence , this petitioner is alleged to have assaulted on the head of brother of informant with iron rod. Doctor has found the injury simple in nature . Case and counter case . Petitioner claims clean antecedent.
4. Learned counsel for the State oppose the bail petition .
5 . Considering the nature of injury , clean antecedent of the petitioner and other circumstances of the case , in the
Patna High Court CR. MISC. No.81554 of 2024(3) dt.23-01-2025 2/2 event of arrest or surrender within eight weeks from today , let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned VIth Additional Chief Judicial Magistrate ,Gopalganj in connection with Kateya P.S. Case No. 312 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
