2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 147, 148, 149, 302 of the Indian Penal Code and section 27 of the Arms Act.
3. As per prosecution case , informant namely, Rahul Kumar alleged that on 23.12.2023 , at about 8 PM , all the F.I.R. named accused including this petitioner came to the house of informant and co-accused Guddu Kumar fired upon grandfather of informant as a result of which he sustained firearm injury and later on died.
4. Learned counsel for the petitioner submitted that petitioner is not the assailant of the deceased. He is only alleged
Patna High Court CR. MISC. No.81156 of 2025(2) dt.27-11-2025 2/2 to have pointed pistol towards the informant and there is no allegation of firing against him. Charge sheet has already been filed. Petitioner is in custody since 30.06.2025 . Similarly situated co-accused have already been allowed bail by this Court vide order passed in Cr.Mis.No. 7804/2025 and 39187/2025 .
4. Learned counsel for the State opposes the prayer for bail.
5. Considering the nature of accusation and period of custody of the petitioner, his prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Sessions Judge , Bhojpur at Ara in Koilwar Police Station Case No. 734 of 2023 .
