1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 323 and 354(b) of the Indian Penal Code.

3. The learned counsel for the petitioner submits that petitioner had moved earlier seeking anticipatory bail by filing Cr. Misc. No.59659 of 2024 and the same was disposed of by an order dated 18.09.2024 in terms of the order dated 13.02.2024 in Cr. Misc. No.3536 of 2024 (Naushad Ansari vs. the State of Bihar).

4. It is next submitted that the case arises out of a complaint case and the same could not be pointed out to the

Patna High Court CR. MISC. No.81086 of 2024(2) dt.24-01-2025 2/3 Court when Cr. Misc. No.59659 of 2024 was taken, as such, the order dated 18.09.2024 was passed in terms of order dated 13.02.2024 in Cr. Misc. No.3536 of 2024 (Naushad Ansari vs. the State of Bihar). It is further submitted that thereafter, the petitioner has filed the instant anticipatory bail application. It is further submitted that from perusal of the allegation as alleged in the complaint, it would manifest that the complainant alleges that the accused persons entered into scuffle with complainant and co-accused Ram Pravesh removed sari of the complainant. It is further submitted that no specific allegation is alleged against the petitioner.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Kaimur in connection with Complaint Case No.252 of 2019, subject to the conditions laid down under Section 438(2) of the

7. The application stands allowed.
