====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-01-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 307, 325, 354(B), 379, 504, 506/34 of the Indian Penal Code.

3. Prosecution case, in brief, is that on 04.07.2023, due to land dispute, petitioners caused hurt to the informant and her son, grandson, husband and granddaughter by means of iron rod and lathi. It is further alleged that during course of causing hurt, petitioner No. 1 tore the blouse of the informant and co-

Patna High Court CR. MISC. No.80244 of 2023(2) dt.10-01-2024 2/2 accused Vipin Yadav took away cash of Rs. 10,000/- from the house of the informant. It is further alleged that co-accused Manita Devi and petitioner No. 4 committed theft of ornament.

4. It is submitted that due to land dispute between the parties, this false and concocted case has been lodged against them. Allegation of assault is general and omnibus. Injuries allegedly caused by the petitioners are simple in nature. Case and counter case. Petitioners claim clean antecedent.

5. Considering the nature of allegation and simple nature of injuries, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Rajaun P. S. Case No. 331 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
