2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 363 and 366 of the Indian Penal Code .
3. As per the prosecution case, co-accused
Patna High Court CR. MISC. No.83494 of 2023(3) dt.19-03-2024 2/3 Niranjan Sah is alleged to have kidnapped the wife of the informant.
4. It is submitted on behalf of the petitioners that petitioner No. 1 is the father of the co-accused Niranjan Sah and petitioner Nos. 2 and 3 are sisters of co-accused Niranjan Sah . There is no specific allegation against these petitioners. They have falsely been implicated in this case because they happens to be the family members of the co-accused Niranjan Sah . These petitioners have neither any concern nor any connection with the alleged occurrence . Petitioners claim clean antecedent.
5 . Learned counsel for the State oppose the bail petition.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.83494 of 2023(3) dt.19-03-2024 3/3 satisfaction of the learned J . M Ist Class, Darbhanga in connection with Bahadurpur P.S. Case No. 332 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
