2. The petitioners seek regular bail in connection with G.R. No. 665 of 2023 arising out of Nirmali P.S. Case No. 157 of 2023, registered for the offences punishable under Sections 411/413/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioners were apprehended by the police with stolen motorcycle.

4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case and on the basis of suspicion they were arrested. He further submits that no incriminating article has been recovered from the possession of

Patna High Court CR. MISC. No.81260 of 2023(2) dt.08-01-2024 2/2 the petitioners. He also submits that petitioners have no relation with the seized motorcycle and both are students having no criminal antecedent. Petitioners are in jail custody since 26.07.2023.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioners.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Supaul in connection with G.R. No. 665 of 2023 arising out of Nirmali P.S. Case No. 157 of 2023.
