This is an appeal under Sections 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, against refusal of the prayer for anticipatory bail by order dated 09.09.2019 in A.B.P. No.6276 of 2019 passed by the learned Additional Sessions Judge-XX-cum-Special Judge, SC/ST, Patna in connection with Kadirganj P.S.Case No. 61 of 2019, G.R.No.729 of 2019 and SPL 323 of 2019 registered under Sections 341,323,504,34 of the Indian Penal Code as well as under Sections 3(i),(r)(s) of the Scheduled Castes and Scheduled Tribes Act.

Patna High Court CR. APP (SJ) No.4980 of 2019(4) dt.20-02-2020 2/2 Appellant No.1-Arjun Prasad and appellant No.2Mantu Prasad have already been arrested and granted regular bail by the learned court below.

After some argument, learned counsel for the appellant No.3-Rasuli Prasad seeks permission to withdraw this appeal.

Accordingly, it is dismissed as withdrawn.

In the event of surrender of the appellant No.3, prayer for regular bail shall be considered without being prejudiced by this order and considering the fact that two other co-accused having identical allegation have already been allowed bail by the learned court below.
