2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Gaurichak P.S. Case no. 356 of 2022 instituted for the offence under Sections 290 and 336 of the Indian Penal Code and Section 25 (9), 27, 28, 29 and 30 of the Arms Act.

3. The case of the prosecution is that one video clip was received by the police in which it was found that a man was firing from rifle and there was also found a music and other persons were seen. With the help of local 'chowkidar', the informant identified this petitioner.

4. Learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.82937 of 2024(2) dt.11-12-2024 2/2 connection with the present case. It has further been submitted that only on the basis of video clip, the petitioner has been made accused in this case. Nothing has been recovered from his conscious possession. Further submission is that though the petitioner is having criminal antecedent of two cases but he is on bail.

5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Gaurichak P.S. Case no. 356 of 2022, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM -II, Patna, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
