The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 504, 506, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Informant in his written complaint has alleged that when they were returning after attending reception, FIR named accused were sitting in verandah of Puto Sah and as they saw them they started abusing them and were in intoxicated condition and there is specific allegation against Dharmendra Singh @ Pathal Singh who was carrying arm in his hand fired upon the son of Informant which caused fire arm injury and thereafter he was rushed to hospital for treatment.

Patna High Court CR. MISC. No.71722 of 2019(3) dt.12-12-2019 2/2 Injury report has been enclosed in case diary according to which Gautam Kumar and vikash Kumar both sustained fire arm injury as such allegation made in the FIR are corroborated by the injury report, I am not inclined to enlarge the petitioner on anticipatory bail.

Hence, the prayer for bail of the petitioner is hereby rejected.

However, it is observed that if petitioner surrenders before the court below and prays for regular bail, his application for regular bail will be considered and disposed of preferably on the same day, without being prejudiced by this order. (S. Kumar, J) ranjan/- U
