2. Petitioner seeks bail, who is in custody since 27.04.2022, in connection with Special Case No. 182 of 2021, arising out of NCB Case No. 27 of 2021 dated 22.11.2021 registered for the offences punishable under Sections 8(C) read with Section 20(b)(ii)(C ) 25 and 29 of the N.D.P.S. Act.
3. The case relates to recovery of 311.600 Kgs. of Ganja from the truck.
4. Earlier the bail petition of the petitioner was rejected vide order dated 23.02.2023 passed in Cr. Misc. No. 51123 of 2022 and thereafter the petitioner has again moved for
Patna High Court CR. MISC. No.83219 of 2024(4) dt.24-01-2025 2/2 bail before this Court in Cr. Misc. No. 5909 of 2024 but the same was rejected vide order dated 23.02.2024.

According to the prosecution story, altogether 311.600 Kgs. of Ganja was recovered from the truck in question and earlier the bail petition of the petitioner was rejected on merit and a counter affidavit has been filed on behalf of Union of India (NCB) in which he has stated that out of six chargesheeted, three witnesses have been examined and four witnesses have been partly examined.

Considering the stand taken by the Union of India (NCB) in the counter affidavit and as per nature of allegation in the F.I.R., I am not inclined to enlarge the petitioner on bail in connection with Special Case No. 182 of 2021 arising out of NCB Case No. 27 of 2021 pending in the Court of learned Additional Sessions Judge-XVII, Patna.
7. Prayer is refused.
8. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Ibrar//- U T
